Terms of Service for Promptville

These Terms of Service ("Terms") govern your access to and use of the Promptville mobile application on Android and iOS, and any related services (collectively, the "Service"). By downloading, accessing, or using Promptville, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About Promptville

Promptville is a competitive, prompt-based game. In each game round:

• Up to five (5) players participate
• A single image generated using a system-defined prompt is presented to all players
• Each player submits a text prompt attempting to best recreate the system image
• User prompts do not generate new images
• All prompts, together with the system prompt and system image, are evaluated by a third-party AI service to score and rank players

Scores are generated algorithmically and may involve subjective evaluation by AI.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Promptville. By using the Service, you represent that you meet this requirement.

3. User Accounts

Promptville may allow or require account creation. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content and Prompt Ownership

4.1 Ownership

You retain ownership of the prompts you submit to Promptville.

4.2 License to Promptville

By submitting prompts, you grant Promptville a limited, non-exclusive, royalty-free license to:

• Process prompts for scoring and gameplay functionality
• Store prompts and scores to provide gameplay history
• Analyze prompts in aggregated or anonymized form to improve the Service

Promptville does not use user prompts to generate images or train proprietary AI models.

5. Acceptable Use

You agree not to submit prompts or content that:

• Are unlawful, abusive, defamatory, hateful, or harassing
• Infringe intellectual property rights
• Contain malware or attempt to disrupt the Service
• Attempt to manipulate scoring systems or exploit bugs

We reserve the right to remove content or restrict access for violations.

6. In-App Credits and Purchases

6.1 Credits

Promptville is free to download. Users may:

• Play a limited number of rounds for free
• Purchase in-app credits to play additional rounds

Credits:

• Have no cash value
• Are non-transferable
• Are non-refundable except where required by law or app store policy

6.2 Payments and Refunds

All payments are processed by the Apple App Store or Google Play. Promptville does not store your full payment information.

Refund requests are handled exclusively by the relevant app store and are subject to their refund policies. Promptville cannot issue refunds directly.

7. AI Scoring Disclaimer

You acknowledge that:

• Scoring is performed by third-party AI systems
• Scores are automated and may be imperfect or subjective
• Promptville does not guarantee accuracy, fairness, or consistency of scores

Scores are final and are not subject to appeal except at Promptville’s discretion.

8. Intellectual Property

All aspects of the Service, including:

• System prompts
• System-generated images
• Game mechanics
• Branding, logos, and design

are owned by Promptville or its licensors and are protected by intellectual property laws. You may not copy, modify, or distribute them without permission.

9. Service Availability

We do not guarantee that Promptville will be available at all times. We may modify, suspend, or discontinue the Service (or any part of it) at any time without liability.

10. Termination

We may suspend or terminate your access to Promptville if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Misuse credits or attempt to bypass payment systems

You may stop using the Service at any time.

11. Limitation of Liability

To the maximum extent permitted by law, Promptville shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or gameplay outcomes
• Dissatisfaction with AI-generated scores or rankings

Your sole remedy is to stop using the Service.

12. Indemnification

You agree to indemnify and hold harmless Promptville from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Apple App Store Additional Terms

If you download Promptville from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Promptville, not Apple
• Apple has no responsibility for the Service or its content
• Apple has no obligation to provide maintenance or support
• In the event of any failure of the Service to conform to applicable warranties, you may notify Apple, and Apple may refund the purchase price (if any), but Apple has no other warranty obligation
• Apple is not responsible for addressing claims relating to the Service, including product liability, legal compliance, or intellectual property infringement
• Apple is a third-party beneficiary of these Terms and may enforce them against you

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
